The petitioner is languishing in jail since 16.04.2015 in a case instituted under Sections 392/34 of the Indian Penal Code. It is alleged by the informant that the informant was going with his motorcycle and when the informant reached at Bimna more, three miscreants came with motorcycle and snatched the motorcycle, laptop and Rs.15,000 and fled away toward Rafiganj.

It has been submitted on behalf of the petitioner that petitioner is in custody since 16.04.2015. Chargesheet has been submitted in the case. There is no allegation of tampering of evidence against the petitioner. Petitioner is not named in the FIR.

Patna High Court Cr.Misc. No.36200 of 2015 (3) dt.05-10-2015 It is a case of single identification after thirty three days of the arrest of the petitioner. There is no recovery of any incriminating article from the possession of the petitioner. On behalf of the State, it has been submitted that the name of the petitioner has come in course of the investigation. Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Miss Akanksha Kashyap, Judicial Magistrate, Ist Class, Gaya in connection with Anti P.S.Case No.02 of 2015.
