The petitioner apprehends his arrest in connection with Piro P.S. Case No. 37 of 2017, registered under Sections 307/34 of the Indian Penal Code and Section 27 of the Arms Act, pending in the court of A.C.J.M.-I, Ara, Bhojpur. The accusation is that the informant, Prakash Kumar Singh, was going to Bachri Bazar on 10.02.2017 at 8 P.M. then in the way, two motorcycles came near him. Out of two motorcycles, one motorcycle was driving by Kamta Pandey and Himansu Pandey, was sat behind him whereas another motorcycle was driving by Nagesh Pandey @ Chodkun, in which, this petitioner sat behind him, having gun in his hand.

Patna High Court CR. MISC. No.32923 of 2019(2) dt.20-05-2019 2/2 Thereafter, Himansu Pandey shot fire on him but the same did not hit anyone and this petitioner also shot fire at the informant causing injury at his right thigh.

Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trial court within four weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
