JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 15-01-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Sheohar Mahila P.S. Case No. 19 of 2020 registered for the offence punishable under Sections 363, 354A, 506 and 34 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner has at the outset drawn my attention to the statement of the victim recorded under Section 164 of the Cr.P.C. to contend that the entire case of the prosecution of kidnapping, as disclosed in the F.I.R., stands belied.

I find substance in the submission made on behalf of the petitioner upon seeing the statement of the victim.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Session Judge 1st-cum-Special Judge, POCSO, Sheohar in Sheohar Mahila P.S. Case No. 19 of 2020.
