2. The petitioner seeks bail in connection with Mithanpura P.S. Case No. 343/2014 registered for the offence punishable under Sections 414/34 of the Indian Penal Code.

3. The following order was passed on 07.11.2023 in Cr. Misc. No. 71352 of 2023:- "Heard the learned counsel for the petitioner and learned counsel for the State.

2. The petitioner seeks bail in connection with Mithanpura P.S. Case No. 343 of 2014 (G.R. No. 6021 of 2014) registered for the offence under Sections 414, 34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner is an absconder of nine years. He had fled away after having been caught by the police in the present F.I.R.

4. Considering the fact that the petitioner has absconded for nine years, therefore, this Court is not inclined to grant bail to the petitioner for the present.

5. Accordingly, the prayer of bail of the petitioner is rejected herewith.

6. The trial of the petitioner is directed to be

Patna High Court CR. MISC. No.38345 of 2024(2) dt.12-07-2024 2/2 expedited and concluded within six months. If the same is not concluded within six months, the petitioner may renew his prayer for bail."

4. The petitioner has made the following statement in paragraph No. 12 of the petition:- "That co-accused Raushan Kumar Singh @ Prakash has already been granted bail by this Hon'ble Court vide order dated 08.07.2015 passed in Cr. Misc. No. 21933 of 2015."

5. Considering the fact that the petitioner has remained in jail since 21.08.2023, this application is allowed.

6. Let the petitioner above named be released on bail after framing of charge, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, East Muzaffarpur/ concerned court in connection with Mithanpura P.S. Case No. 343/2014.

7. The Court below is directed to expedite the framing of charge.

8. The petitioner will co-operate in the trial. He will appear regularly in the trial either personally or through his Advocate.
