Mr.Lalan Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 15-11-2021 Heard learned counsel for the petitioners and the State. Petitioners seek regular bail in a case registered for the offence punishable under section 376D and (A) of the Indian Penal Code and section 6 of the POCSO Act land section 66b of the IT Act.
As per the prosecution case, these petitioners committed rape on the victim.
Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. He submits that during trial none of witnesses examined including the victim, her father and mother have supported the
Patna High Court CR. MISC. No.45756 of 2021(2) dt.15-11-2021 2/2 prosecution case. In support of the same, petitioners have annexed copies of their depositions contained in Annexure 2 series. Petitioners claim clean antecedent and they are in custody since 18.12.2020.
Considering the aforesaid facts and circumstances of the case and the aforesaid depositions, prayer for bail of the petitioners is allowed. Let all the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge VI cum Special Judge, POCSO Act Nawada.
