The petitioner seeks bail in anticipation of his arrest in connection with Mahua P.S. Case No. 707 of 2019 instituted for the offences under Sections 430(a) 32(ii) 34(ii) 33(ii) and 41(i) of the Bihar Prohibition and Excise Act, 2018.

Regard being had to the fact the fact that the petitioner was earlier made accused in the cases of similar nature, I am not inclined to grant anticipatory bail to the petitioner.

The prayer for anticipatory bail is rejected.

No.32954 of 2020(2) dt.22-02-2021 2/2 However, if the petitioner surrenders before the Court below and seeks bail, the court below shall take into account the age of the petitioner and other attendant facts and shall pass orders in accordance with law without being prejudiced by the fact that the present petition for grant of anticipatory bail has not been entertained.
