2. Heard learned counsel for the petitioner and learned A.P.P. for the State.

3. The petitioner seeks regular bail in connection with Khushrupur P.S. Case No.330 of 2022 dated 27.08.2022, lodged under Sections 302/34 of the Indian Penal Code read with Section 27 of the Arms Act.

4. As per prosecution case, the F.I.R. has been lodged against twenty named accused persons and the specific allegation is against one Rajendra Prasad @ Baudhu who has fired on the head of informant's mother due to which she died.

5. Learned counsel for the petitioner submits that the allegation against the petitioner is to assault the informant with a view to kill but anyhow the informant saved his life and fled away. He further submits that antecedent of petitioner is clean,

Patna High Court CR. MISC. No.35740 of 2023(2) dt.24-06-2023 2/2 he is in custody since 14.02.2023 and chargesheet has already been filed in this case. He further submits that similarly situated co-accused namely Suresh Singh has been granted bail by this Hon'ble Court vide order dated 10.05.2023 passed in Cr. Misc. No.16187 of 2023. Learned counsel also submits that petitioner is ready to fulfill all the conditions whatsoever shall be imposed upon him.

6. Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned J.M.-1st Class, Patna City in connection with Khushrupur P.S. Case No.330 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

8. With this observation, the bail application stands allowed.
