Mr.Ahmad Ali ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-05-2019 Petitioner seeks bail in connection with Kasba P.S. Case No. 339 of 2018 registered for the offences punishable under Sections 392 and 411 of the Indian Penal Code. Allegation as per FIR is that while the informant was going to deposit money amounting to Rs.14,77,000/- to the Bank on scooty and when he reached near Vishari Temple, two persons sitting on motorcycle came and snatched the bag from the informant containing the money and they fled away towards Jalalgarh and later on one person was arrested and on the basis of his confession money was recovered from the house of the petitioner.

Submission of learned counsel for the petitioner is that he has been named in this case on the basis of confession made by co-accused and and he was not put on T.I. parade and

Patna High Court CR. MISC. No.33471 of 2019(2) dt.21-05-2019 2/2 there is no identification as such it cannot be said that the recovered money was looted money and he has no criminal antecedent and is in custody since 31.12.2018. Heard learned APP also.

In view of above facts and circumstances, I am not inclined to grant bail to the petitioner at this stage. This application is, accordingly, dismissed.
