JUSTICE PRABHAT KUMAR JHA ORAL ORDER 07-10-2015 Heard both sides The petitioner seeks bail in a case under Section 20(b)(ii)(c) of the NDPS Act.

The prayer for bail of the petitioner was earlier rejected vide order dated 10.07.2014 passed in Cr. Misc. No. 28668/2014. The learned trial court was directed to expedite the trial and conclude the same preferably within one year. It is submitted that the trial is yet to be concluded. The petitioner is in jail since 27.02.2013.

Since commercial quantity i.e. 25.450 Kg. of brown sugar was recovered from the possession of the petitioner, I am not inclined to enlarge the petitioner on bail in Special Case No. 09/2013, arising out of Narcotics Control bureau Case No. 55/13. Accordingly, the same is rejected.
