2. Petitioners seeks bail who are in custody since 25.01.2026 in connection with Lodipur P.S. Case No. 19 of 2026, F.I.R. dated 25.01.2026 for the offences punishable under Sections 191(2), 191(3), 190, 126(2), 115(2), 118(1), 109(1), 352, 351(2) of the Bharatiya Nyay Sanhita, 2023.
3. According to prosecution case, the informant alleged that on 24.01.2026, the petitioners and other accused persons intercepted the informant's party near the house of Munilal Mandal. It is alleged that two of the accused persons
Patna High Court CR. MISC. No.36644 of 2026(2) dt.15-06-2026 2/3 hurled bomb-like objects with the intent to kill, resulting in serious injuries to five individuals, including the informant.
4. Learned counsel for the petitioners submits that petitioners are innocent and they falsely been implicated in the present case. The allegation levelled against the petitioners is false and fabricated. Although the petitioners are named in the FIR but from bare perusal of the FIR it appears that specific allegation of throwing bomb like substance is against coaccused persons, namely, Srikant Mandal and Gona @ Gohna Mandal and at best the petitioners are only member of the mob. The police after investigation submitted charge-sheet against the petitioners and the petitioners are in custody since 25.01.2026.

The learned Additional Public Prosecutor has vehemently opposed the prayer for bail of the petitioner and submits that petitioner no.2 has clean antecedent and petitioner no.1 has got five criminal antecedents other than the present one but fairly submits on the basis of paragraph-3 of the bail petition that he is acquitted in two out of five cases.
6. Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned
Patna High Court CR. MISC. No.36644 of 2026(2) dt.15-06-2026 3/3 S.D.J.M., Bhagalpur in connection with Lodipur P.S. Case No. 19 of 2026, subject to the following conditions:- i. Petitioners shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the court and on their absence on two consecutive dates without sufficient reason, their bail bond shall be cancelled by the Court below. ii. If the petitioners tamper with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.
iii. And further condition that the court below shall verify the criminal antecedent of the petitioners and in case at any stage it is found that the petitioners have concealed their criminal antecedents, the court below shall take step for cancellation of bail bond of the petitioners. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
