JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 14-12-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Minapur P.S. Case No. 256 of 2020 registered for the offence punishable under Sections 272, 273/34 of the Indian Penal Code and Section 30(a)/41 of the Bihar Prohibition and Excise Act, 2018.

It is alleged that during the course of a raid conducted by the police, nearly 69.950 liters of illicit liquor was recovered. The petitioner is in custody since 12.07.2020. Learned counsel appearing on behalf of the petitioner has submitted that the petitioner has no criminal antecedent, as is evident from paragraph 3 of the application. He

Patna High Court CR. MISC. No.33133 of 2020(2) dt.14-12-2020 2/2 has further submitted that only on the basis of recovery of illicit liquor from the petitioner's house, which is in joint possession, the petitioner has been implicated.

Be that as it may, considering the fact that the petitioner is in custody since 12.07.2020 and the charge-sheet is said to have been submitted, this application is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Spl. Judge, Excise, Muzaffarpur in Minapur P.S. Case No. 256 of 2020.
