====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 09-11-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 307, 379, 506 and other allied sections of Indian Penal Code.
As per prosecution case, all the FIR named persons including this petitioner assaulted the son of the informant and snatched away Rs. 3 lacs. This petitioner indiscriminately inflicted blows on the head of the son of the informant (Vishwajeet) by means of iron rod.
Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. It is further submitted that though some altercation took place between the parties but FIR for the same has been lodged after delay of 2 days and as per injury report of the
Patna High Court CR. MISC. No.36264 of 2022(2) dt.09-11-2022 2/2 victim injury allegedly caused by the petitioner is simple in nature.
Considering the aforesaid facts and circumstances and nature of injury, let the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate VI, Kaimur at Bhabua in Kudra P. S. Case No. 94 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
