JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 22-06-2021 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner apprehends his arrest in connection with Phulwari Sharif P.S. Case No. 662 of 2019, registered under Sections 363, 365 and 366A of the Indian Penal Code. The accusation is that daughter of informant, aged about 15 years, moved for market in the early evening of 05.07.2019 but she did not return. While daughter of the informant was searched but no trace was found. Thereafter, he came to know that his minor daughter has been enticed away by Rahul Sharma (petitioner).
Learned counsel for the petitioner submits that, in fact, daughter of the informant left her parental house according

No.35721 of 2020(2) dt.22-06-2021 2/2 to her own sweet will and performed the marriage with the petitioner on 17.11.2019 due to settlement of her marriage by a person, aged about 41 years, which would appear from her statement recorded under Section 164 of the Cr.P.C on 08.06.2020 and also her age was assessed by the court about 19 years.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Judge-IXcum-A.C.J.M., Patna, in connection with Phulwari Sharif P.S. Case No. 662 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
