Roy No.1 (APP) ====================================================== CORAM: HONOURABLE THE ACTING CHIEF JUSTICE ORAL ORDER 28-08-2015 This is an application, made under Section 439 of the Code of Criminal Procedure, seeking bail for the accusedpetitioner, namely, Rajesh Yadav @ Baidya, in connection with Sessions Trial No.155 of 2013, arising out of Banka Police Station Case No.58 of 2011, under Sections 448, 323, 324, 325, 326, 307, 384, 302, 504 and 34 of the Indian Penal Code and Sections 25(1) (a), 27 and 35 of the Arms Act. Perused the above application and materials on record.

Heard Mr. Shyamehwar Kumar Singh, learned Counsel for the petitioner, and Mr. Jitendra Kumar Roy, learned Additional Public Prosecutor, appearing on behalf of the State. Considering the nature of incriminating materials available on record against the accused above-named, this Court

Patna High Court Cr.Misc. No.35567 of 2015 (2) dt.28-08-2015 2/2 is of the view that at this stage, the accused above-named shall not be allowed to go on bail.

In view of the above and in the interest of justice, the prayer for bail is hereby rejected at this stage. Considering, therefore, the matter in its entirety and in the interest of justice, it is further directed that the learned Additional Sessions Judge-IV, Banka, shall expeditiously deal with the case and conclude the same, within a period of six months from the date of receipt of a copy of this order. This bail application shall stand disposed of accordingly.
