The petitioners apprehend their arrest in a case registered for the offences punishable under Section 406 of the Indian Penal Code.
Learned counsel for the petitioners submits that petitioner nos. 1 and 3 are persons with clean antecedent, petitioner no.2 has antecedent of one case and the complainant alleges that her husband was a drunkard and had died on 01.05.2015, further on 06.01.2019 accused persons were measuring her land and on inquiry they disclosed that four

No.36179 of 2022(2) dt.29-11-2022 2/3 decimal of land was purchased by them from her husband by a sale deed dated 08.06.2012, it is next alleged that no land was sold by her husband rather few years back accused persons had taken his husband's signature in the name of getting loan for a tractor and misused the same.
Learned counsel for the petitioners submits that petitioners have been falsely implicated in the present case, it is next submitted that dispute is purely civil in nature, it is also submitted that already a sale deed dated 08.06.2012 stands executed and if the informant is aggrieved by the execution of sale deed then she has remedies available in law of getting the sale deed canceled.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with
