2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 103(1), 238, 3(5) of the Bharatiya Nyaya Sanhita.
3. As per the prosecution case, on 19.01.2025 at about 7.00-8.00 P.M, the brother of informant went to Imaliyachak, but could not return till night and in the next morning, his dead body was found hanging with a gamchha (towel) in a dilapidated house of Housing Board behind D.P.S. School. It is further alleged that on 08.01.2025 a quarrel happened between the deceased and petitioner & co-accused Chintu Kumar @ Babu. Informant suspects that this petitioner and co-accused, Chintu Kumar @ Babu have committed murder of his brother and hanged his dead body.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Informant is not an eye witness of the occurrence and only suspicion has been raised against the petitioner on account of previous enmity. Similarly situated co-accused, namely, Chintu Kumar @ Babu has already been granted anticipatory bail by this Court vide order dated 24.03.2026 passed in Cr. Misc. No. 88794 of 2025.
5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gayaji in connection with Rampur P. S. Case No. 27 of 2025, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Prabhat Kumar Singh, J) Navya/Sanjay U T
