The petitioners are apprehending their arrest in connection with Forest Case No.42 of 2018 , registered for offences punishable under Section 33 of the Indian Forest Act. Allegation against the petitioners is of making construction over the forest land.

Submission of the learned counsel for the petitioners is that the land was acquired by the Forest Department and the allegation is false and concocted. He is ready to co-operate to

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Aurangabad in connection with Forest Case no.42 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition that the petitioners shall co-operate the Forest Authority in removal of the encroachment. .

With the aforesaid direction, this application is allowed.
