The petitioner is languishing in jail since 31.12.2014 in a case registered for offences punishable under Section 365 of the Indian Penal Code.

The prosecution case is that Kundan Kumar, son of the informant, Suresh Yadav, was coming on his motorcycle after closing his Mobile shop at Nauranga Mor, at about 9 P.M. on 22.12.2014 but as soon as he reached 50 yards ahead of Nauranga, 3-4 unknown persons came down from their Bolero vehicle, intercepted his son, Kundan Kumar and forcibly took away in their Bolero and thus they kidnapped him The informant received the information of the alleged occurrence by nearby shopkeepers.

Patna High Court Cr.Misc. No.37102 of 2015 (2) dt.31-08-2015 2/2 It has been submitted by the learned counsel for the petitioner that on the confessional statement under Section 164 of the Cr. P. C. by the victim Kundan Kumar, the name of the petitioner along with three others has surfaced. Amongst them, one Raushan Kumar sinha @ Raushan Lala @ Pintoo Sinha has been granted privilege of bail in Cr. Misc. No. 35591 of 2015 dated 27.08.2015 by a Co-ordinate Bench of this Court. I do not propose to take a different view on the same and similar allegation.

In view of the facts and circumstances, let the petitioner, namely, Raju Kumar Sinha @ Raju Sinha @ Pintoo Sinha be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Mufasil P.
