2. The petitioner seeks bail in a case registered for the offence punishable under Sections 341, 342, 379/34 of the Indian Penal Code and subsequently Sections 395, 412 of the IPC has been added.
3. Some unsocial elements committed theft of huge quantity of wire, scrap of conductor, electric conductor etc. from the godown.
4. Learned counsel for the petitioner submits that the petitioner is innocent, not named in the FIR and has been falsely implicated in this case. He submits that name of the petitioner has come during investigation on the basis of confessional statement of other co-accused. He further submits
Patna High Court CR. MISC. No.39324 of 2024(2) dt.31-07-2024 2/2 that petitioner has no criminal antecedent as stated in para-3 of the bail application and he is languishing in judicial custody since 24.04.2024.
5. Learned APP for the State opposes the prayer for bail.
6. Considering the facts and circumstances of the case, let the above named petitioner, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Thali P.S. Case No. 124 of 2023.
