JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-11-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

One six round pistol containing six cartridges, is said to have been recovered from conscious possession of the petitioner when the petitioner along with others assembled to make preparation for bank dacoity.

Submission on behalf of the petitioner is that for the above-said occurrence two cases, i.e. the present case and Kishanganj P.S. Case No. 182 of 2015 were registered and petitioner has already been granted privilege of bail in Kishanganj P.S. Case No. 182 of 2015.

Considering the aforesaid facts and circumstances of the case as well as submissions of the parties and taking note of

Patna High Court Cr.Misc. No.38904 of 2015 (3) dt.09-11-2015 this fact that the petitioner does not have any criminal antecedent, let the petitioner named above, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Kishanganj P.S. Case No. 183 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Kishanganj.
