This application for grant of anticipatory bail arises out of Udakisunganj P.S. Case No. 06 of 2016, disclosing offences under Sections 307, 325, 341, 342, 384, 386, 379, 447, 506/34 of the Indian Penal Code.

It is alleged that the co-accused Manoj Yadav was demanding extortion from the informant, who had purchased some land. When the demand was not fulfilled, allegedly the said Manoj Yadav alongwith other accused persons including the petitioner assaulted the informant.

Patna High Court Cr.Misc. No.24076 of 2016 (5) dt.14-07-2016 2/2 has submitted that allegation against him is concocted and it is basically land dispute between informant and said Manoj Yadav that this case has been lodged implicating the petitioner who is associated with Manoj Yadav. It has also been submitted that till date, no grievous injury has been reported on the person of the informant.

Considering the above, this application is allowed. Let the petitioner, above-named, in the event of his arrest/surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Madhepura, in Udakisunganj P.S. Case No. 06 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

This is subject to the condition that the petitioner shall present himself before the police/court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutives occasions, his bail bonds shall be liable to be cancelled.
