2. This appeal is preferred for the grant of bail against the order dated 01.03.2024 passed by the learned 1st Additional Sessions Judge cum Spl. Judge S.C/S.T.(POA)Act, Sitamarhi, in connection with Runni Saidpur P.S. Case No. 106 of 2020 offences punishable under sections 302 and 34 of the Indian Penal Code and sections 3(1)(r)(s) and 3(2)(va) of the S.C./S.T. (POA) Act.
3. In this case the coordinate Bench had called for the
Patna High Court CR. APP (SJ) No.2329 of 2024(5) dt.24-10-2024 2/2 report regarding the stage of the trial and as per it, four out of ten prosecution witnesses have been examined till the letter dated 07.08.2024 was issued.
4. Allegation against the appellants is/are of assaulting the informant's father-in-law brutally which ultimately led to his death at the S.K. Medical College and Hospital, Muzaffarpur.
5. Considering the aforesaid facts as also that the trial is on, it will be appropriate that the appellant faces trial.
6. Accordingly, the appeal stands rejected for the present.
