Heard the learned counsel for the petitioners as well as the learned counsel for the informant.

The petitioners apprehend their arrest in connection with Kateya P.S. Case No. 87 of 2020 registered for offence punishable under sections 341, 323, 498A, 504 of the Indian Penal Code and section 3/4 of the Dowry Prohibition Act. As per allegation, the marriage of Ankita Devi was solemnized with Sandeep Gond in the year 2018 with Hindu

Patna High Court CR. MISC. No.36087 of 2022(3) dt.04-01-2023 2/3 rites and customs. The accused persons inflicted cruelty on the informant for non-fulfillment of demand of dowry of Rs.2,00,000/- cash. Ultimately, they ousted her from the matrimonial house.

The learned counsel for the petitioners has submitted that petitioner no. 1 is brother-in-law (Devar), petitioner no. 2 is sister-in-law (Nanad) and petitioner no. 3 is mother-in-law of the victim Ankita Devi and they have no concern with day-today affairs of the couple. On the other hand, the learned counsel for the informant as well as Md. Matloob Rab, the learned APP for the State have opposed the prayer for bail.

Considering the fact that the petitioners are the close relatives of the husband of the informant and they are supposed to have no concern with day-to-day affairs of the couple, let them, in the event of their arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Kateya P.S. Case No. 87 of 2020, subject to condition as laid down under section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the
