The case is registered under Section 394 of IPC in connection with Nokha P.S. Case No. 37 of 2021. As per the prosecution story, the informant has alleged that he along with the driver Md. Adil had returned back to Sasaram by his Maruti Omni when some unknown persons on motorcycle intercepted them and on the point of pistol after assaulting them, snatched Rs. 30-40 thousands as also mobile phone.
Learned counsel for the petitioner submits that during the course of investigation, his name has come up but

No.36360 of 2022(2) dt.19-09-2022 2/3 despite the fact that he is in custody since 24.8.2021, nothing incriminating has been recovered from his conscious possession, he has been implicated in this case only because of the fact that he has more than a half dozen criminal cases under his belt. Considering the fact that the petitioner is in custody since 24.8.2021, charge-sheet stands submitted, no T.I. parade has been done nor anything has been recovered from his conscious possession, this Court is inclined to grant him the privilege of bail after framing of the charges. Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Nokha P.S. Case No. 37 of 2021 subject to the following conditions: (i) one of the bailors should be the family members of the petitioner, who shall provide official document to show his/her bona fide;
(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reasons will entail his cancellation of bail by the Trial Court itself;
(iii) he shall appear before the concerned police

(iv) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds. Considering the fact that he has nine criminal cases under his belt, the Superintendent of Police, Rohtas at Sasaram is directed to look into the matter and take necessary remedial steps.
Let a copy of this order be sent to the office of Superintendent of Police, Rohtas at Sasaram.
