The petitioner seeks bail in connection with Laukha (Lalmania O.P.) P.S. Case No. 259 of 2018 dated 31.10.2018 instituted for the offence under Sections 20(B) and 23 of the Narcotic Drugs and Psychotropic Substances Act.

One Md. Tahir was arrested and from his possession 51⁄2 kgs. of Ganja was recovered. Aforesaid Md. Tahir is said to have disclosed that the Ganja was handed over to him by the petitioner.

Learned counsel for the petitioner submits that but for the confession of an arrested accused person from whose possession Ganja was recovered, there is no other material to connect the petitioner with the offence.

Patna High Court CR. MISC. No.35193 of 2019(3) dt.06-09-2019 2/2 The petitioner is in custody since 31.03.2019. The other case in which the petitioner has been made accused earlier is also on the basis of confession and in those cases, the petitioner is on bail.

Considering the aforestated facts the petitioner above named is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Madhubani in connection with Laukha (Lalmania O.P.) P.S. Case No. 259 of 2018.
