JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 10-03-2021 As prayed for, let the learned counsel for the petitioners remove the defect(s), as pointed out by the office vide it's note, dated 07.12.2020, within four weeks of starting of the Court proceeding in physical mode properly. Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the state through Virtual Court. The petitioners seek pre-arrest bail in connection with Purnea Sadar P.S. Case No. 21 of 2020, registered under Section 304B/34 of the Indian Penal Code.

The accusation is of killing of daughter of the informant by her husband and in-laws due to non-fulfillment of dowry by pressing the neck.

Submission is that petitioners 1 to 5, namely, Md.

Patna High Court CR. MISC. No.33442 of 2020(2) dt.10-03-2021 2/2 Sayeed, Md. Sabir, Md. Jabeer, Baby Khatoon @ Samina Khatoon and Yasmeen Khatoon, are respectively father-in-law, two brothers-in-law, nanad and gotni of the deceased daughter of the informant. After marriage of the deceased daughter of the informant with Md. Tabrez, son of petitioner no. 1, both used to reside separately, but, with ulterior motive petitioners, being the members, have falsely been implicated in this case. Further, submission is that more over, Md. Tabrez, husband of the deceased, is in custody.

Having regard to the facts and circumstances of the case, let the petitioners, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Purnea Sadar P.S. Case No. 21 of 2020 shall be released on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
