This is the second attempt for grant of regular bail on behalf of the petitioner inasmuch as earlier bail application of the petitioner was dismissed as withdrawn vide order dated 22.12.2021 passed in Cr. Misc. No. 33766/2021 with an observation that the petitioner may renew his prayer for bail after six months.

Allegation as per FIR is that from possession of the petitioner one country made pistol along with one live cartridge were recovered. Thereafter, on search of his house, two country made pistols and three live cartridges were recovered from the bed of the petitioner.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case by the police

Patna High Court CR. MISC. No.36079 of 2022(2) dt.13-07-2022 2/2 with oblique motive and the petitioner is in custody since 25.12.2020.

Regards being had to the submissions made by the parties and taking into consideration the fact that this is the second attempt for bail on behalf of the petitioner, he is in custody since 25.12.2020 and the charge-sheet has been submitted, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, namely, MAHESH PASWAN be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty-five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Barh, Patna in connection with Bakhtiyarpur PS Case No. 294/2020.
