Petitioner is not named in the first information report and the name of petitioner came in this case during course of investigation in the statement of a witness, namely Dhanraj Devi, who claimed that it was the petitioner who gave Fatta blow to the deceased. The petitioner and the informant are co-villagers and had the petitioner participated in the alleged crime, he would have certainly been named by the informant who claimed himself to be eye witness of the alleged occurrence.

Accordingly, the petitioner named above, is

Patna High Court Cr.Misc. No.36447 of 2015 (2) dt.31-08-2015 2/2 directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Aurangabad Muffasil P.S. Case No. 131 of 2012 to the satisfaction of Learned Chief Judicial Magistrate, Aurangabad.
