This application for grant of regular bail arises out of Excise P.S. Case No. 805 of 2019, registered for the offence punishable under Sections 30(a) of Bihar Prohibition and Excise Act (Amendment) 2018 and Rules 2(e), 3, 5(b) and 13 of the Mahua Flower Rules, 2006.
The petitioner's prayer for regular bail was earlier rejected by this Court by an order dated 28.02.2020 passed in Cr. Misc. No. 10284 of 2020, with an observation that he may renew his prayer for bail after six months, if there is no progress at the trial.
It has been stated in the present application renewing prayer for regular bail that there is no substantial progress in the trial. The petitioner was apprehended by Excise Officials with
Patna High Court CR. MISC. No.33518 of 2020(2) dt.25-01-2021 2/2 800 kg Mahua flower loaded in a vehicle, which was being driven by him. It has been stated in paragraph 3 of the application that the petitioner has no criminal antecedent. Considering the submission advanced on behalf of the petitioner that the petitioner has no criminal antecedent, the fact that there is no likelihood of conclusion of trial in near future and keeping in mind the observation made by this Court in the order dated 28.02.2020 passed in Cr. Misc. No. 10284 of 2020, this application is allowed.
Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Gaya, in Excise P.S. Case No. 805 of 2019.
