Name of the petitioner came in the statements of co-accused Niraj Kumar Patel and Bhushan Kumar Gupta who stated that the petitioner had made plan to commit murder of a business man but according to the prosecution case itself, when FIR named accused Niraj Kumar Patel and Bhushan Kumar Gupta were caught by the police, petitioner was not along with them.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge VI, East Champaran at Motihari in Sessions trial no. 193/2015 arising out of Harshidi P.S. Case no. 376/2014.
