Heard the parties.

The petitioners are languishing in custody for the offence punishable under Sections 30/30(a)/38(i)(ii) of Bihar Excise (Prohibition) Amendment Act, 2016.

The F.I.R. relates to recovery of foreign liquor from a four wheeler. The petitioners were on the said vehicle. Petitioners have stated on oath that they have got no criminal antecedent. They are in custody since 18.08.2020. Investigation of the case is already complete.

Considering the facts aforesaid, let the petitioners,

Patna High Court CR. MISC. No.29521 of 2020(2) dt.11-11-2020 2/2 above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) each with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Manjhi P.S. Case No. 235 of 2020, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioners shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.

(c) The petitioners shall not leave the country without permission of the trial Court.
