The petitioner was neither caught on the spot nor anything was recovered from his conscious possession and it appears that the name of petitioner was disclosed by co-accused, Lallan Singh, who was caught on the spot with fire-arms. Moreover, the petitioner does not have any criminal antecedent and is languishing in jail custody since 27-04-2015. Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Nauhatta P.S. Case No. 11 of 2015 to the satisfaction of Sri Divesh Kumar, Judicial Magistrate-Ist Class, Dehri, Rohtas.
