Petitioners are named along with others and according to the prosecution case itself, alleged occurrence took place on account of cutting of a tree.

It is alleged that petitioners and others assaulted the informant by legs and fists as a result of which she sustained injuries and later on died in course of her treatment. Learned counsel for the petitioners submits that having more or less similar allegation co-accused Chandeshwar Chaudhary has already been granted privilege of bail by a coordinate bench of this court and moreover, no external injury was found on the person of the deceased at the time of post mortem examination.
