The petitioner seeks bail in anticipation of his arrest in connection with Sherghati P.S. Case No. 37 of 2020, dated 26.01.2020, instituted for the offences under Sections 147, 148, 149, 435 and 427 of the Indian Penal Code and Section 27 of the Arms Act. It is alleged in the F.I.R. that some persons were trying to burn a tractor and a motorcycle. On
Patna High Court CR. MISC. No.32483 of 2020(2) dt.12-02-2021 2/3 chase, the accused persons ran away raising slogans in favour of a banned political outfit. The petitioner is said to have been identified in the torch light while fleeing away from the place of occurrence.
It has been submitted on behalf of the petitioner that he has falsely been implicated in this case, even though he hails from the same village. The petitioner was earlier made accused in three cases, but those cases are of Exercise Act and of theft. In all the above-noted cases, he has been granted bail.
Considering the nature of accusation and the manner in which the petitioner has been identified as one of the accused persons, he, in the event of his arrest or surrender before the learned Court below within a period of eight weeks, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Sherghati,
