ABHISHEK REDDY ORAL ORDER 04-12-2023 Learned counsel for the petitioner has stated that as against the order of cancellation passed by the Sub Divisional Officer, the petitioner has preferred an appeal bearing Appeal No. 577 of 2021 before the District Magistrate. Learned counsel has stated that since 13.09.2021 the appeal is pending and till date no orders are passed by the District Magistrate (Respondent No. 2).

2. Learned counsel has stated that a direction may be issued to the Respondent No. 2 to dispose of the appeal by

Patna High Court CWJC No.9484 of 2022(3) dt.04-12-2023 2/2 fixing a time frame.

3. Learned counsel appearing on behalf of the Respondents has stated that he has no objection with the direction is given to the Respondent No. 2 to dispose of the appeal strictly in accordance with law on its own merits.

4. Having regard to the above said submissions, the writ petition is disposed of with a direction to the Respondent No. 2 to dispose of the appeal bearing Appeal No. 577 of 2021 dated 13.09.2021 pending before him as expeditiously as possible preferably within a period of eight weeks from the date of receipt of the copy of this order.

5. It is needless to mention that before passing any order, the petitioner shall be given an opportunity of hearing and thereafter orders passed. Any order passed shall be communicated to the party.
