The petitioner is in custody in a case registered under Sections 302/34 of the Indian Penal Code.

It is alleged by the informant that on 21.6.2014 at about 2 P.M. he was sitting at his darwaza, in the meantime petitioner along with other came there and took his son, namely, Pranay Choudhary, to perform love marriage about 1 year ago and after that marriage father-in-law, brother-in-law of his son always came at his darwaza and threatened to kill him. On 21.6.2014 at about 7 P.M. the informant got information that all the accused persons along with the petitioner killed him.

It has been submitted on behalf of the petitioner that the

Patna High Court Cr.Misc. No.39644 of 2015 (3) dt.13-10-2015 2/2 petitioner has got no criminal antecedent. He is in custody since 8.7.2015. Charge sheet has been submitted in this case. There is no allegation of tampering with the evidence against the petitioner. It is a case of last seen. The wife of the deceased has been examined in para 64 of the case diary where she has not named this petitioner rather she has alleged that her father and brother have committed the murder of her husband.

On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the facts aforesaid, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri R.K.Singh, learned Judicial Magistrate, 1st Class, Samastipur in Tajpur P.S.Case No.189 of 2014.
