JUSTICE ASHUTOSH KUMAR ORAL ORDER 15-12-2020 Heard Mr. Ajay Kumar Sinha, learned counsel for the petitioner and learned APP for the State. The petitioner seeks bail in connection with Bhagwanganj P.S. Case No. 54 of 2020 dated 20.04.2020 instituted for the offences under Sections 147, 148, 149, 323, 341, 386, 387, 120(B), 506 of the Indian Penal Code, Sections 18, 20 U.A.P. Act and Sections 25(1-b)a, 26, 35 of the Arms Act.

The accusation, as it stands against the petitioner, is that he and another were arrested by the police on confidential information and from the possession of the petitioner, prohibitive literature was found. From the

Patna High Court CR. MISC. No.33459 of 2020(2) dt.15-12-2020 2/2 possession of another accused person, two live cartridges were recovered.

Learned counsel for the petitioner has submitted that only because in the past he was made accused in about four cases, he has been made accused in the present case also on suspicion. In the four other cases, which have been lodged against him in the past, he has been acquitted. The petitioner is in custody since 21.04.2020. Regard being had to the afore-stated facts and the nature of accusation, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Masaurhi, Patna, in connection with Bhagwanganj P.S. Case No. 54 of 2020.
