====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 25-06-2019 Heard learned counsel for the petitioners and the State.

The petitioners seek bail in Industrial Area P.S. Case No. 70 of 2018, instituted for the offence under Section(s) 414 of the Indian Penal Code.

It is alleged in the written report that Informant on getting confidential information that petitioners are dismantling one stolen Motorycycle with the help of Mechanic near their house, he along with other Police personnel reached the place of occurrence. On seeing the Police party some persons started running away. Out of them one person with parts of old Motorcycle was apprehended by the Police who disclosed his

Patna High Court CR. MISC. No.37191 of 2019(2) dt.25-06-2019 2/2 name as Rajprakash @ Bhutail @ Bhutai (petitioner). It is further alleged that those parts were parts of the stolen Motorcycle. The name of petitioner No. 2 has been disclosed by petitioner No. 1.

Counsel for the petitioners submits that petitioner No. 1 is in custody since 2.5.2018 and petitioner No. 2 is in custody since 8.7.2018. No T.I.P. of recovered articles has been held till date. Petitioner has been arrested merely on suspicion. Considering the aforesaid facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Hajipur, Distt. Vaishali, in connection with Industrial Area P.S. Case No. 70 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioners.
