The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 363 and 366A of the Indian Penal Code.
The statement of the victim girl has been recorded under Section 164 of the Cr.P.C. in which she has stated that she has solemnized marriage with the petitioner out of her own sweet will, on 18.09.2018 and are living together as husband and wife. The victim girl has also stated that she is major and in fact the court below has also accessed her age to be 18 years. Considering the facts aforesaid, let the petitioner
Patna High Court CR. MISC. No.34793 of 2019(2) dt.29-05-2019 2/2 above named, in the event of his arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XII, Patna/successor Court in connection with Patliputra P.S. Case No. 399 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bonds of the petitioner.
