JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-08-2019 This is an application for grant of anticipatory bail in connection with Pipriya P. S. Case No. 45 of 2018, disclosing offences under Sections 498A, 304B, 201, 34 of IPC and Section 3⁄4 of Dowry Prohibition Act.

Petitioner no.1 is the Gotini, petitioner no.2 is fatherin- law and petitioner no.3 is Bhaisur of the deceased and the case is of dowry death.

Submission of the learned counsel for the petitioners is that there is no specific allegation against any of the petitioners, rather there is general and omnibus allegation against them.

No.34760 of 2019(3) dt.07-08-2019 2/2 Heard learned A.P.P. as well as learned counsel for the opposite party no.2 also, they have opposed the prayer for anticipatory bail on the ground that the deceased was killed by setting her on fire and the husband of the deceased is still absconding.

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioners no.1 & 3, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned C.J.M. Lakhisarai, in connection with Pipriya P. S. Case No. 45 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. So far as, petitioner no.2 is concerned, I am not inclined to grant privilege of anticipatory bail to him. With the aforesaid, this application is disposed of.
