Admittedly, petitioner has retired from the post of Panchayat Secretary on 28.02.2014 and made several representations but his retiral dues are still pending. The Administrative/Controlling Officer of the petitioner, B.D.O. has filed counter affidavit, in which it has been categorically stated that payment of leave encashment, upadaan and group insurance have been cleared. Arrear of salary, as stated in paragraph-12 of the counter affidavit, has been paid.

Patna High Court CWJC No. 14196 of 2021(2) dt.12-01-2023 2/2 Learned counsel for the petitioner submits that salary of his suspension period and amount towards arrear of his promotion has not been paid.

Learned counsel for the petitioner submits that all admissible dues has been paid. For the amount of A.C.P. and its arrear, final decision has to be taken at the level of Committee. There is every likelihood that it may be finalized within 2 weeks.

In the light of the submission made above, this application is disposed off with liberty to the petitioner that he shall calculate his dues and the amount on which he is not satisfied and shall made claim within 4 weeks from today and respondent no. 8 shall pass a reasoned order upon the representation filed by the petitioner within 6 weeks, thereafter, the admissible dues shall be paid within 8 weeks about, which indication has been made in the counter affidavit.
