The petitioner seeks bail in anticipation of his arrest in connection with Forbesganj (Simraha) P.S. Case No. 209 of 2020 dated 14.03.2020 instituted for the offences under Sections 414/34 of the Indian Penal Code read with Section 11 of the Prevention of Cruelty to Animal Act, 1960.
The petitioner is sought to be prosecuted in this case because he happens to be owner of the vehicle in question as also the cattle, which were found loaded in a crammed condition over such vehicle.
The learned counsel for the petitioner has submitted that neither the vehicle nor the cattle are stolen property. The
Patna High Court CR. MISC. No.21467 of 2021(2) dt.13-05-2022 2/2 petitioner had purchased the cattle from a particular cattle farm, the detail of which has been provided in this application. Considering the aforenoted facts, the cattle in question were released in favour of the petitioner.
Regard being had to the aforenoted submissions, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Forbesganj (Simraha) P.S. Case No. 209 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
