The petitioner apprehends his arrest in a case registered for the offence under Sections 147, 148, 427, 353, 323, 332, 435 and 307 of the Indian Penal Code. The prosecution case, in brief, is that after an accident took place, in which, 5 FIR accused, including this petitioner, and 20-25 unknown persons became violent and attacked the police party, in which, some of the police personnel sustained injury. It is further alleged that they also set on fire some trucks. It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case. Patna High Court CR. MISC. No.35978 of 2022(2) dt.07-11-2022 2/2 took place on the road. No specific overt act has been alleged against the petitioner. Petitioner has got clean antecedent. Three co-accused persons have already been granted anticipatory bail by a coordinate Bench of this Court, vide order dated 13.05.2022 passed in Cr.Misc. No. 13686/2022 (Annexure - 2). Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Lakhisarai in connection with Suryagarha P.S. Case No. 91 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
