The present criminal miscellaneous application has been filed under Sections 483 and 484 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'the BNSS, 2023') for grant of regular bail to the petitioners they are in custody in connection with Barabar Tourism P.S. Case No. 16 of 2025, lodged on 18.02.2025 under Sections 126(2), 115(2), 191(2), 191(3), 190, 109(1), 103(1), 118(1), 61(2), 352 of B.N.S.

As per the prosecution, there were nine persons accused in this case and they all armed with different weapons have started abusing the informant at his door, upon restraining they started assaulting to the informant, due to which the husband and Devar of the informant got injured and subsequently, the husband was declared dead.
4. Learned Counsel for the petitioners submits that the petitioners are innocent and have committed no offence. Counsel also submits that specific allegation against one Sube Yadav to assault by iron rod on his eye and head due to which he injured. He further submits that the another allegation is against co-accused Anuj Kumar. Counsel further submits that there is no specific allegation against the present petitioners and all are female but they have been made accused in the present case only being the family members. There is no act or overt act against the petitioners. Counsel further submits that antecedents of the petitioners are clean and they are in custody since 18.02.2025.
5. Learned APP for the State opposes the prayer for bail of the petitioners and submits that specific allegation is against one Sube Yadav to assault the husband of the informant which resulted into his death and against co-accused

In the present facts and circumstances of this case, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) each as mentioned in Section 2(1)(d) of the BNSS, 2023 to the satisfaction of Smt. Kumari Dimppy, Judicial Magistrate, 1st Class, Jehanabad, in connection with Barabar Tourism P.S. Case No. 16 of 2025, subject to the conditions as laid down U/s 480(3) of the BNSS, 2023.
