JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-11-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Although 8 persons are named with omnibus allegation of assault but in course of investigation, witness Sabita Kumari, who happens to be daughter of the deceased, claimed that it was the petitioner who was carrying Tangi in his hand at the time of alleged occurrence and gave Tangi blow causing injury on forehead of deceased.

The postmortem report reveals that two incised wounds were found on the person of the deceased. Therefore, taking note of aforesaid facts as well as submissions of the parties, I am not inclined to release the petitioner on bail, at least, at this stage and accordingly, his prayer

Patna High Court Cr.Misc. No.36926 of 2015 (4) dt.06-11-2015 2/2 for bail in connection with Kochas P.S. Case No. 100 of 2014 pending in the court of learned Chief Judicial Magistrate, Rohtas, Sasaram stands rejected.
