JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-05-2019 Petitioner seeks regular bail in connection with Tariyani P.S. Case No.59 of 2019 registered for the offence punishable under Section 30(a) of the Bihar Prohibition & Excise Act, 2016.

Allegation as per F.I.R. against the petitioner is of recovery of 53 liters of illicit liquor, cash of Rs.7750/- and one Black Colour Nokia Mobile from the possession of the petitioner. Petitioner is named in the F.I.R and it appears that he is an accused in another case.

Submission of the learned counsel for the petitioner is that nothing has been recovered either from his conscious possession or from his house and neither his name was disclosed by co-accused. He is in custody for more than two months and he is on bail in another case.

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned 2nd Additional District & Sessions Judge-cum-Special Judge, Excise, Sheohar, in connection with Tariyani P.S. Case No.59 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
