This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 328 and 379/34 of the Indian Penal Code, registered in connection with Goraul P.S.Case No. 76 of 2023.

As per allegation, two unknown persons boarded the e-rickshaw of the informant. Some intoxicants were sprinkled by those persons on the face of the informant, as a result of which he became unconscious. The accused persons fled away with the e-rickshaw and a mobile set of the informant. The learned counsel for the petitioner has submitted that there is nothing against the petitioner in the entire investigation. Nothing was recovered from his possession. His name has figured only on the basis of some secret information received by the Investigating Officer. The petitioner is in

Patna High Court CR. MISC. No.37498 of 2023(2) dt.03-07-2023 2/2 custody since 23.03.2023. He has also submitted that the petitioner is a person of clean antecedent.

Since nothing was recovered from the possession of the petitioner having clean antecedent and is in custody since 23.03.2023, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Hajipur, Vaishali in connection with Goraul P.S.Case No. 76 of 2023, subject to the following conditions:-

1. The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

2. If the petitioner is found involved in future in the similar type of offence, his bail bond shall be liable to be cancelled.
