JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-11-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be step brother of deceased and so far as informant is concerned; he happens to be father of the deceased but he deserted his wife as well as deceased when deceased was only one year old. The motive behind the alleged occurrence is said to have grabbing of lands, which had been transferred by maternal grandfather of the deceased in favour of the deceased. The petitioner has been made accused only on the ground that he confessed his guilt before the villagers but in course of investigation, only three witnesses claimed the aforesaid fact and according to submission of learned counsel, appearing for petitioner, almost all the aforesaid three prosecution witnesses are

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Amdabad P.S. Case No. 209 of 2014 corresponding to Sessions Trial No. 81 of 2015 to the satisfaction of learned Additional Sessions Judge-III, Katihar. (Hemant Kumar Srivastava, J) A.K.V./- U T
