The petitioner happens to be the proprietor of M/s Mayank Pharma wherefrom huge quantities of Pan 40 tablets were recovered. It is alleged that the aforesaid tablets were spurious in nature.
It is contended that admittedly the present case has not been lodged by the Drug Inspector and moreover, there is nothing on the record to show that the present case has been instituted after examining the seized medicines chemically.
Considering the facts and circumstances of the case and submissions made on behalf of the parties, petitioner above named is directed to be released on bail on furnishing bail bond of
Patna High Court Cr.Misc. No.37194 of 2015 (2) dt.01-09-2015 2 / 2 Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya, in connection with Kotwali P. S. Case no. 260 of 2015.
