====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 30-07-2025 Heard learned counsel for the petitioner, learned counsel for the Union of India and learned APP for the State.

2. The petitioner has preferred this application for grant of regular bail in connection with NCB Case No. 10 of 2019, NDPS Case No. 07/2019 dated 29.04.2019 registered for the offences punishable under Sections 20(b)(ii)(c) and 29 of the Narcotic Drugs and Psychotropic Substance Act.

3. As per the prosecution case, total 581 Kgs of ganja was recovered from the truck.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.34820 of 2025(2) dt.30-07-2025 2/3 this case. No incriminating article has been recovered from the conscious possession of the petitioner. The name of the petitioner has transpired in this case merely on suspicion. The petitioner is neither the owner nor the driver of the seized vehicle as stated in para-9 of the bail petition. The petitioner is the Khalasi of the seized vehicle. It is further submitted that the charge has been framed and only two P.Ws. have been examined by the prosecution. The petitioner has no concern with the alleged recovery. The petitioner has no criminal antecedent as stated at para 3 of the bail petition. The petitioner is in custody since 29.04.2019. The co-accused person has already been granted regular bail by this Court vide order dated 18.03.2025 passed in Cr. Misc. No. 6657 of 2025.

5. Learned A.P.P. for the State and learned counsel for the Union of India have vehemently opposed the bail petition of the petitioner and submitted that the seized contraband is more than commercial quantity.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court

No.34820 of 2025(2) dt.30-07-2025 3/3 concerned, Bhagalpur in connection with NCB Case No. 10 of 2019, NDPS Case No. 07/2019, with the following conditions:- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled. (ii) The petitioner is directed to co-operate in the trial before the learned court below.
